As you might now, this Sunday, November 13th at 3PM, a court ordered Elections to the Club Board and Audit Committee will be held. The Election is a result of a frivolously filed lawsuit to challenge June 12th 2022 elections to fill the leadership positions vacant due to the numerous resignations of the former Board members, previously taken to court.
Attached below is the list of candidates received by 10/28/22 deadline.
The following names were submitted after 10/28 and are currently the write-in candidates: Anna Saczko – for Rental Director position, Witold Dębski for Building Director position, Teresa Maik for Secretary, and Anna Spencely to Audit Committee.
All positions are still open and members can submit their nominations for any position by email sent directly to the Polish Club Election Committee:

SPOTKANIE CZŁONKÓW Z MEDIATOREM SĄDOWYM
W niedzielę 9 października o godz. 15:00, w budynku Klubu odbedzie się spotkanie mediatora z członkami Klubu, na którym odpowie na pytania dotyczącze nadchodzących listopadowych wyborów oraz nadzoru kuratora sądowego nad Klubem po wyborach. Zapraszamy wszystkich do uczestnictwa.
MEETING WITH THE COURT MEDIATOR
Today, the first session with the court appointed mediator took place. On Sunday, October 9 at at 3PM, the mediator will hold a meeting with the members in the Club building, where he will answer questions about the upcoming November elections and post Election Court Special Master supervision. We invite everyone to participate.

Informujemy, iż decyzją sądu po rozprawie w dniu 26 sierpnia 2022 r., wybory zaplanowane na 11 września br. zostają przesunięte na niedzielę 9 października lub 13 listopada (patrz orzeczenie w sprawie 022CV31729). Ma to dać stronom czas na mediację.
W dniu wczorajszym, strony wspólnie wybrały mediatora sądowego – emerytowanego sędziego Charles Pratt, który rozpocznie swoją pracę po oficjalnym zaakceptowaniu jego kandydatury przez sąd. Biografia mediatora: https://jaginc.com/pratt-charles/
W świetle powyższego wyroku sądowego, wybory które odbyły się na parkingu w dniu 12 czerwca br. są nieważne, a poprawne i legalne wybory do Zarządu Klubu odbędą się na jesieni, pod nadzorem sądu.

Dear Members,
After the hearing on August 26, 2022, the Court issued an order regarding the Polish Club of Denver Elections. Club Election scheduled for September 11th, 2022 is being postponed to either October 9 or November 13 to allow the parties sufficient time to mediate their disputes (please see the attached Court Order in Case No. 022CV31729).
Yesterday, the parties jointly selected a court mediator: a retired District Judge Charles Pratt, who will begin his work as soon as approved by the Court. Mediator’s bio: https://jaginc.com/pratt-charles/
In the light of the above court ruling, based upon the Court mandated new election, the events that took place on the Club parking lot on June 12th 2022 are null and void. New Club elections will take place in the Fall, under close supervision of the court.

My name is Robert Runco and I am the attorney for the Polish Club of Denver.
As recently communicated, Club President Agnieszka Nalecz-Gembicka has resigned and there are several vacant positions on the Board. In accordance with Club Constitution and By-Laws, in the absence of the President, Vice President Katarzyna Zak and the remaining members of the Executive Board continue to be responsible for managing the Club general business until the new election.
In this situation, the Club Constitution dictates that in case of a vacancy in any position of the Executive Board, members vote to elect the replacement at the next assembly meeting.
The next Polish Club members meeting is planned for September 2022. Therefore, a new election for all Board positions and for the Audit Committee will be held on Sunday September 11th 2022.
It will be the first General Membership meeting following the annual summer recess. The Club does not typically hold events or meetings in June, July or August as many members of the Club travel abroad to Poland and elsewhere during the summer. Given that all qualified members should have the opportunity to vote for the Club’s leadership, it is reasonable to not call a special meeting for an election during the summer break.
The September election will be held according to the following voting procedures outlined in the Club’s By-laws and Constitution:
To qualify as candidate for the Club Board or the Auditing Committee position, a member must be in good standing for at least 6 months before the election (Constitution, Art. V, Sec. 4). To qualify as candidate for President and Vice-President a member must be in good standing at least 6 months before the election and must have attended at least three meetings prior to the election (Constitution, Art. V, Sec. 5).
Due to the timing of the election, rather than conducting two votes in immediate succession, the September 2022 Election will be in place of the regular November 2022 Election. Term of new Board and the Audit Committee members elected in the September Election will commence at the October general membership meeting and will last for a term of 2 years and 3 months (October 2022 to December 2024). In November 2024 the normal elections shall resume and the newly elected Board and Audit Committee members shall serve for a regular term of two years beginning in January 2025.

POWIADOMIENIE O WYBORACH
Szanowni Państwo,
Nazywam się Robert Runco i jestem prawnikiem Polskiego Klubu w Denver.
W maju b.r. Prezes Klubu, Agnieszka Nałęcz-Gembicka, złożyła rezygnację ze swojego stanowiska. Dodatkowo, w Zarządzie Klubu jest obecnie kilka wakatów.
Zgodnie z Regulaminem Klubu, pod nieobecność Prezesa, Wiceprezes Katarzyna Żak oraz pozostali członkowie Zarządu (Pani Barbara Woloch, Pani Małgorzata Jońska, Pani Izabela Mikołajczak Rose) tymczasowo odpowiadają za prowadzenie Klubu do czasu nowych wyborów, i planują zakończenie działalności na obecnych stanowiskach w Zarządzie z dniem zebrania wyborczego.
Konstytucja Klubu mówi, iż w przypadku zaistnienia wolnego miejsca na jakimkolwiek stanowisku w Zarządzie, członkowie Klubu wybierają na najbliższym zebraniu następcę na wolne stanowisko. Kolejne zebranie członków Klubu planowane jest na wrzesień 2022, po letniej przerwie.
W związku z powyższym, nowe wybory na wszystkie stanowiska w Zarządzie Klubu oraz do Komisji Rewizyjnej odbędą się w niedzielę 11 września 2022 roku, w budynku Klubu.
Będzie to pierwsze zebranie członków po dorocznej przerwie letniej (czerwiec, lipiec, sierpień). Zważywszy na fakt, że wszyscy pełnoprawni członkowie Klubu powinni mieć możliwość udziału w głosowaniu na kierownictwo Klubu, wybory do Zarządu nie mogą odbyć się w przerwie letniej kiedy Klub nie organizuje imprez ani spotkań a wielu członków Klubu wyjeżdża.
Wrześniowe wybory odbędą się zgodnie z następującymi procedurami określonymi w Regulaminie i Konstytucji Klubu:
Podstawą zakwalifikowania się do wyborów na jakiekolwiek stanowisko w Zarządzie lub Komisji Rewizyjnej Polskiego Klubu w Denver jest przynależność do Klubu przynajmniej sześć miesięcy przed wyborami. Kandydaci na Prezesa i Wice-Prezesa muszą być pełnoprawnymi członkami Polskiego Klubu od sześciu miesięcy oraz dodatkowo muszą być obecni na przynajmniej trzech zebraniach członkowskich Polskiego Klubu przed wyborami.
Ze względu na wcześniejszy termin tegorocznych wyborów, wrześniowe wybory zastąpią regularne wybory, które według Konstytucji Klubu, planowane były na listopad b.r. Kadencja członków nowego Zarządu i Komisji Rewizyjnej wybranych we wrześniowych wyborach rozpocznie się na październikowym zebraniu członków i potrwa 2 lata i 3 miesiące (od października 2022 do grudnia 2024). W listopadzie 2024 r. wznowione zostaną regularne wybory, a nowo wybrany Zarząd i Komisja Rewizyjna rozpoczną swoją regularną, dwuletnią kadencję od stycznia 2025 roku.
Jeśli planujecie Państwo udział we wrześniowych wyborach, proszę upewnić się, że są Państwo pełnoprawnymi członkami Polskiego Klubu w Denver. Tylko pełnoprawni członkowie mają prawo do głosowania i mogą zajmować stanowiska w Zarządzie oraz w Komisjach.
